In 1986 Congress passed the Emergency Planning and Community Right-to-Know Act (EPCRA), also known as Title III of the Superfund Amendments and Reauthorization Act (SARA). Title III was designed to combat only one type of disaster: hazardous materials.
Section 301 of EPCRA mandated the formation of LEPCs throughout the country, at the discretion of the State. The activities of the LEPC are overseen by the State Emergency Response Commission (SERC). The SERC’s purpose is to coordinate the state’s planning and preparedness activities for hazardous materials in compliance with Title III.
The LEPC is the focal point for the Title III activities in the community. The performance of the LEPC is critical to ensuring that the public benefits from the opportunities and information provided in the law.
